Terms & Conditions

  1. These term and condition are applicable every time you access our website and /or order goods from our website. Please note that these terms also incorporate the following sections which we advise that you read.
  2. We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special , indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.
  3. Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods.
  4. A person who is not a party to these terms and conditions shall have no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
  5. We may assign or transfer any of our rights or sub contract any of our obligations under these terms and conditions to any third party.
  6. You may not assign or transfer any of your rights or sub contract any of your obligations under these terms and conditions except with our specific permission in writing.
  7. We reserve the right to change these terms and conditions from time to time and any such changes will be communicated on our website.
  8. If there are links on our website to third party websites which we believe may be of interest to you. We do not have any control over the content of these websites nor can we be liable in respect of anything contained on these websites.
  9. These terms and conditions govern the entire trading relationship between ourselves and you and will remain in force for the duration of our trading relationship.

Delivery UK                                                                         
We normally deliver direct to your door within 5 days for ‘in stock’ item. To avoid disappointment, please allow a little extra time during busy sales periods.  Personalised items may take a little longer. If we are unable to deliver the Goods within 5 (five) working days then we shall use every reasonable means to contact the Buyer of this by e-mail, phone or fax and give an amended delivery time Please ensure your delivery receipt is kept safe.

Duty tax
No duty applies to goods shipped within the European Union. Outside the EU any duty and customs costs appropriate to your country are your responsibility.

Risks

The responsibility of products purchased at HeadsTurn shifts to the costumer at the time/date of delivery.

Near Dead Stock (N.D.S*)
Some of our Trainers will show very light signs of scuff. They may have been laced up or put on display and they may have been tried on. Some may also have stains, stitching errors or scratches due to manufacturing or storage. These items will be sold at a reduce price.

Samples (S*)
Shoes manufactured in limited amount to display to retailers of new production line. Please Note some of these samples do not come in boxes.

Sale and Near Dead Stock items
S* and N.D.S* items on our  web site are non-refundable; you will only be entitled to an exchange within 30 days of purchase.

Colour Variation
We make all effort to ensure that all descriptions and colours are accurate on our web site. However because of individual colour setting of your monitor this may cause slight variation between the on screen colour and the actual product colours.

Order

Our acceptance of your order takes place upon despatch of the goods to you at which point the purchase contract is made. We reserve the right to decline your order for any reason whatsoever and to refuse bulk orders.

Payment
We currently accept the following methods of payment.

  • Visa Debit

Payment may be made by any of the methods above.  The total amount you pay is the same, regardless of the payment method you use. Payments will be processed using our PayPal Account. If for any reason we haven’t got sufficient stock of all or some of the goods order, we shall notify the Buyer by e-mail or telephone, informing the Buyer and if payment has been taken, HeadsTurn shall credit the Buyer's credit card or debit card account with the price of goods unavailable.

PRICES
The price for the Goods shall be those prices published on the web site when the order is accepted by HeadsTurn. These prices are inclusive of VAT, where applicable.

HeadsTurn current delivery charges and anticipated delivery times are as published on the Web Site and for the purposes of the Contract shall be that information on the web Site at the time when the Order is accepted by HeadsTurn.
HeadsTurn reserves the right to amend the price stated on the Web Site (or any other typographical, clerical or other error or omission on the Web Site) at any time.  Where there is a difference between the price of any Goods or delivery charges at the time the Order is made and the time when the Order is accepted, then HeadsTurn will inform the Buyer by email or telephone and confirm whether the Buyer wishes to proceed with the purchase at the altered price.  If the Buyer elects not to proceed with the purchase then if any payment has been taken, this shall be re-credited to the Buyer's credit or debit account.

How to care
Shoe are not suitable for washing/machine, this may remove colours and stitching.

Damaged or incorrect orders

We try very hard to ensure that you receive your order in pristine condition. If you do not receive all your products, please check that they have been despatched by visiting track an item link at royalmail.com

Warranties and liability
1. Unless you are buying the Goods as a consumer (as defined in the Sale of Goods Act 1979) all warranties, conditions or other terms implied by common law or statute (except the condition relating to the passing of title in goods implied by section 12 of the Sale of Goods Act 1979 as amended) relating to the Goods are excluded to the fullest extent permitted by law.

  • If you are buying the Goods as a consumer your statutory rights are not affected by these Terms.
  • We will not be liable for any fault in the Goods which is caused by wear and tear, neglect, wilful damage, abnormal use or failure to follow instructions for the care of the Goods.
  • We will not be liable to you or be deemed to be in breach of the Contract as a result of any delay in performing or failure to perform any of our obligations relating to the Goods if our delay or failure is due to any cause beyond our control. These causes include, but are not limited to, Acts of God, explosion, flood, fire, storm, war, riot, national emergency, strikes or other industrial action or power failure.

Termination
We may at any time terminate or suspend any part of the Service without notice to you.

Returns

Goods return must be unused or unworn, with the original delivery docket (as proof of purchase) and the original packaging within the original purchase date. Customers are entitled to a full refund within 28 days of purchase, after this period customer are only entitled to an exchange. Please state your reason for return of purchase; this will help us to improve our quality control when we examine the returned goods. Please note Postage and package charge will be deducted from return goods.

Refunds
Refunds will only be made to the credit/debit card that was used to purchase goods. Refunds can only be made after goods have been received.

Returns via the Post Office/or any other courier service

It is imperative you obtain a Free Certificate of Posting from the Post Office/ or any other courier service which should be kept in a safe place as this will be required if any returned parcels should go astray. This will contain a unique reference number which should be quoted in the event of a query.

Further Notes
Failure to produce a Certificate of posting (from the Post Office) or a receipt (from your courier) when a parcel has gone astray will mean we will not be able to credit your Personal Account accordingly. If you are returning goods that have been paid for by credit card, the card adjustment will be made directly to your account.

All images (logos, photography, graphics and software) are protected by UK copyright laws. You are entitled to use our website for shopping purpose only. Copying or downloading from this Website without written permission from Heads Turn is strictly prohibited and will be deemed an infringement of copyright. All intellectual property rights (including use of trade marks) shall be solely owned by us.
